1. Agreement to these terms
By accessing or using FFDS Hub, you agree to these Terms of Service and the Privacy Policy. If you use FFDS Hub on behalf of a business or organization, you represent that you are authorized to bind that organization to these terms.
2. Eligibility and account responsibilities
You must provide accurate account information, maintain the confidentiality of your credentials, and promptly notify FFDS of suspected unauthorized access. You are responsible for activity performed through your account unless prohibited by applicable law.
FFDS may assign different roles and permissions to administrators, staff, clients, and other users. You may not attempt to access functions, records, or client information outside your authorized role.
3. Permitted use
FFDS Hub may be used for legitimate business operations, including project management, content production, client approvals, analytics, reporting, media storage, website workflows, communications, and related agency services.
You agree not to:
- Use FFDS Hub in violation of law, third-party rights, or platform policies.
- Upload malicious code, attempt unauthorized access, bypass security controls, or interfere with platform operation.
- Use another person’s credentials or misrepresent your identity or authority.
- Collect, export, disclose, or use client or connected-platform data for an unauthorized purpose.
- Reverse engineer, copy, resell, sublicense, or commercially exploit FFDS Hub except under a written agreement with FFDS.
4. Connected third-party accounts
FFDS Hub may allow users to connect services such as Facebook, Instagram, Google, or other providers. You represent that you have authority to connect each account and authorize the requested access.
Third-party services are governed by their own terms, policies, permissions, availability, and technical limits. FFDS is not responsible for provider outages, permission changes, API limitations, account restrictions, or data discrepancies caused by those services.
5. Client content and data
You retain ownership of content and business data you lawfully provide to FFDS Hub. You grant FFDS a limited license to host, process, reproduce, modify, transmit, and display that content only as reasonably necessary to provide the platform and contracted services.
You are responsible for confirming that uploaded content, contact lists, media, trademarks, music, copy, and other materials may lawfully be used. FFDS may remove or restrict content that appears unlawful, harmful, infringing, or inconsistent with client agreements.
6. Analytics and automated outputs
Analytics, forecasts, alerts, recommendations, summaries, and AI-assisted outputs are provided for informational and operational purposes. They may contain delays, estimates, omissions, or errors due to incomplete data, provider reporting differences, automated processing, or user configuration.
Users should review material reports and recommendations before making financial, advertising, legal, employment, or other consequential decisions.
7. Fees and separate service agreements
Access to FFDS Hub may be included in a separate client service agreement, subscription, retainer, project scope, or statement of work. Fees, deliverables, payment terms, cancellation rights, ownership terms, and service levels in a signed agreement control if they conflict with these general terms.
8. Availability and changes
FFDS may modify, suspend, or discontinue features to improve the platform, address security concerns, comply with provider requirements, or manage operational needs. We do not guarantee uninterrupted or error-free availability.
9. Suspension and termination
FFDS may suspend or terminate access for nonpayment, security risk, unauthorized activity, violation of these terms, legal requirements, or termination of the underlying client relationship. Users may stop using FFDS Hub at any time and may request account or data deletion subject to applicable retention obligations.
10. Disclaimers
To the maximum extent permitted by law, FFDS Hub is provided “as is” and “as available.” FFDS disclaims implied warranties, including merchantability, fitness for a particular purpose, noninfringement, and warranties arising from course of dealing or usage of trade.
11. Limitation of liability
To the maximum extent permitted by law, Family First Digital Solutions LLC and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities arising from FFDS Hub.
Any aggregate liability will be limited to the amount paid to FFDS for the affected service during the three months preceding the event giving rise to the claim, unless a signed agreement or applicable law requires otherwise.
12. Governing law
These terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in a court of competent jurisdiction located in Oklahoma County, Oklahoma, unless a signed agreement states otherwise.
